Do I Need Terms and Conditions on My Website?
Do small business websites need terms and conditions? General information on when T&Cs are needed, what they cover and how they differ from a privacy policy.

Short answer: Not every website legally needs terms and conditions, but most businesses benefit from them, and if you sell online, take bookings or take deposits, clear terms are strongly advisable and often expected under consumer law. They set out how you work, protect you in disputes and reassure customers. This is general information, not legal advice.
Terms and conditions vs privacy policy
These two get mixed up constantly, but they do different jobs:
- Privacy policy: explains how you collect and use personal data. If you collect any personal data, privacy laws in many countries effectively require one.
- Terms and conditions: the rules of doing business with you, or of using your website. Covers payments, cancellations, liability and so on.
Some businesses also have separate website terms of use covering how people can use the site itself, and terms of sale covering purchases.
When you really should have them
Selling products online
Consumer protection rules in many countries require you to give buyers certain information, such as total price, delivery arrangements, cancellation rights and your business details. Terms of sale are the natural place to set this out.
Taking bookings or deposits
Salons, trades, photographers, tutors and venues all deal with no-shows and late cancellations. Without written terms, enforcing a cancellation fee or keeping a deposit is much harder.
Offering services or subscriptions
Spell out what is included, payment terms, how to cancel and what happens if either side does not deliver.
Hosting user content
If customers can post reviews, comments or uploads, terms let you set rules and remove inappropriate content.

What good terms usually cover
- Who you are: business name, address, contact details and registration number if applicable.
- What you provide and how orders or bookings are confirmed.
- Prices, payment methods and when payment is due.
- Cancellations, refunds and deposits.
- Delivery or service timescales.
- Limits of liability, within what the law allows.
- How complaints and disputes are handled.
- Which country's law applies.
Mistakes to avoid
- Copying another business's terms: they may not fit your services, may be for a different country, and copying text can raise copyright issues.
- Unfair terms: in many places, terms that unfairly disadvantage consumers are unenforceable, however clearly they are written.
- Hiding them: link your terms in the footer and at checkout or booking. Customers should see them before they commit.
- Never updating them: if your prices, policies or services change, update the terms and date them.
Where to get them
For simple service businesses, reputable template services and trade associations can be a sensible starting point, as long as you adapt them properly. For online shops, subscription services or anything higher risk, a solicitor or lawyer who understands your sector is worth the fee. Online generators vary widely in quality, so read whatever they produce carefully.
Once you have your terms, putting them on your website is the easy part. SiteDrum builds legal pages into the footer of every site, and you supply or approve the wording. See our plans for what is included.
The bottom line
Terms and conditions are not always legally required, but if you sell, take bookings or take deposits, you should have them. Keep them specific to your business, fair, easy to find and up to date. For anything complex, get professional help. This is general information, not legal advice.
Frequently asked questions
Is it a legal requirement to have terms and conditions?
Not always, but businesses selling online often must give customers certain information, and terms are the usual way to do it. This is general information, not legal advice.
What is the difference between terms and conditions and a privacy policy?
Terms set the rules for buying from you or using your site. A privacy policy explains how you handle personal data.
Can I copy terms and conditions from another website?
It is not recommended. They may not fit your business or country, and copying text can raise copyright issues.
Where should terms and conditions appear on my website?
Link them in the footer and show them at checkout or booking, so customers can read them before they commit.
