Do I Need a Privacy Policy on My Website?

Does your small business website need a privacy policy? When it is required, what to include, and how it relates to cookies and contact forms.

Do I Need a Privacy Policy on My Website?

Short answer: if your website collects any personal data, such as through a contact form, booking tool, analytics or email signup, you should have a privacy policy. In many countries it is a legal expectation. This is general information, not legal advice.

When you need one

  • Contact or quote forms.
  • Newsletter signups.
  • Bookings or payments.
  • Analytics, cookies or tracking pixels.
  • Live chat tools.

What to include

  1. Who you are and how to contact you.
  2. What data you collect and why.
  3. How long you keep it.
  4. Who you share it with, such as form or email providers.
  5. People's rights over their data.
  6. How you use cookies.

Privacy and cookie basics included.

Where to put it

Link it in your footer and near forms where you collect data.

The bottom line

A clear, honest privacy policy protects your customers and your business. Keep it accurate and update it when your tools change.

Frequently asked questions

Can I copy another website's privacy policy?

No. It should reflect your own data practices.

Is a privacy policy the same as terms and conditions?

No. Privacy covers data; terms cover the rules of using your service.

Do I need one if I only have a contact form?

Generally yes, because a form collects personal data.

Should I get legal advice?

For complex data use, a professional review is wise.
